The federal Born Alive Infants Protection Act was introduced in 2000 to provide legal protection to all born babies, wanted or not, including the right to medical care. The IDPH cited the clinic for such violations as storing food items in the same freezer that contained containers of fetal tissue, filthy floors, medication dispensing cups filled with crumbs of medication, recovery rooms with rusted walls, and other filthy conditions. The IDPH report also noted that one employee was re-using discarded paper towels on patients. Worse, the IDPH charged the clinic for failing to perform CPR on a patient who soon died in its care.

"Abortion center closes after run of difficulties" lamented a Washington Post headline on the front page of the July 15 edition's Metro section. "New regulations hamper relocation effort," a subheadline for staff writer Tom Jackman's story noted. But deep in his 20-paragraph story, Jackman noted that the Fairfax City, Va., clinic, Nova Women's Healthcare, was sued in late 2011 and that court documents in that suit referred to sick patients "lying down in corridors... and, in some instances, even vomiting." In the 16th paragraph of his story, Jackman admitted that "One filing said witnesses would testify that this was a daily occurrence."

The state is shutting down an abortion provider in Cuyahoga Falls. The Ohio Department of Health recently issued an order to Capital Care Network, 2127 State Road, saying it was revoking the clinic’s Health Care Facility license to operate an outpatient surgical facility. The clinic is prohibited from “performing medical services, including surgical procedures, pharmaceutical services and anesthesia services,” according to an April 16 adjudication order. The state health department did an annual inspection at Capital Care on Feb. 14 and found numerous Ohio Administrative Code violations. The department issued a notice that it planned to revoke the clinic’s license.

The Virginian-Pilot reports that the abortion clinic’s closure comes about a week after Virginia’s Board of health voted to implement a law requiring abortion facilities “to meet strict, hospital-style building codes.”... Three remaining abortion clinics in southeastern Virginia are upgrading their facilities to comply with the new Virginia regulations. Planned Parenthood has also complied.

An increased scrutiny of Illinois abortion clinics in the wake of revelations about a "house of horrors" in Philadelphia revealed that some facilities had gone up to 15 years without inspections, and two now have closed after regulators found health and safety violations. Go To Site

In the trial of Kermit Gosnell, horrifying testimony was offered Tuesday from Gosnell’s sister-in-law’s common law husband, James Johnson, who worked as a janitor, maintenance man, and “plumber” at Gosnell's clinic. Johnson testified he had threatened to quit because he would not retrieve babies’ body parts from the toilets where they had been stuffed. Johnson said he would lift the toilet so that someone else could get the babies out of the pipes. Johnson was supposed to collect the body parts, including babies’ arms, from the toilets, which backed up at least once a week. He was supposed to shovel the body parts into bags and then put the bags in a rat-infested basement.

Agents expected to find evidence that it was illegally selling prescription drugs. On entering, they quickly realized something else was amiss. In the grand jury report's telling, "There was blood on the floor. A stench of urine filled the air. A flea-infested cat was wandering through the facility, and there were cat feces on the stairs. Semi-conscious women scheduled for abortions were moaning in the waiting room or the recovery room, where they sat on dirty recliners covered with blood-stained blankets.

A series of emergency calls made from the Planned Parenthood of Delaware this year are raising concerns about what's happening behind the closed doors. Two former nurses who both quit are speaking exclusively with Action News about what they saw inside. Jayne Mitchell-Werbrich, former employee said, "It was just unsafe. I couldn't tell you how ridiculously unsafe it was." Werbrich alleges conditions inside the facility were unsanitary. "He didn't wear gloves," said Werbrich. Another former employee, Joyce Vasikonis told Action News, "They were using instruments on patients that were not sterile." The former nurses claim that a rush to get patients in and out left operating tables soiled and unclean. Werbrich said "It's not washed down, it's not even cleaned off. It has bloody drainage on it." "They could be at risk of getting hepatitis, even AIDS," added Vasikonis.

Detective James Wood was also on the stand today. He talked questioning Gosnell about fetuses found in the clinic's freezer. According to his testimony, Gosnell admitted that 10 to 20-percent of the fetuses found in plastic bags "may have been" over 24.5 weeks old. Gosnell is accused of manipulating the clinic's ultrasound machine to make fetuses look younger than they were. Wood testified that when he questioned Gosnell about that, "Gosnell's face changed, his color changed and he didn't answer the question."

Dr. Emily's abortion clinic in the Bronx, New York, has been formally charged based on complaints filed by Operation Rescue in January related to the illegal dumping of private medical information and aborted baby remains and other infectious waste on a city sidewalk outside the abortion clinic. In addition to the illegal dumping charges, Dr. Emily's abortion clinic lost its accreditation with the Joint Commission for Office Based Surgery, a national organization that boasts on its web site that its accredited organizations reflect quality and meet certain performance standards.

Four Women in Attleboro, one of Gordon’s abortion clinics with ties to Merrimack Valley Women’s Health, was recently found by the Massachusetts Department of Public Health to be in violation of laws concerning medical waste management, including failure to maintain medical waste record-keeping log and failure to maintain written contingency plan for spills and accidents. Two doctors accused of performing late-term abortions in Maryland have been arrested and charged with murder after police found a freezer full of 20-35 week fetuses. The investigation of the doctors started over a year ago when they allegedly botched an abortion on an 18-year-old girl, leaving her with a ruptured uterus.

Pennsylvania health officials say renewed inspections uncovered poor conditions at two Philadelphia-area abortion clinics in the months after a drug investigation revealed a "house of horrors" facility operating for years in the city. The physician who operated the two Abortion as an Alternative Inc. clinics, in Bensalem and the Germantown section of Philadelphia, received scathing reports and was ordered to suspend performing abortions. Two days later, Dr. Soleiman M. Soli, 73, announced he would shut down the clinics instead. He then retired, according to the state Department of Health.

An Alabama abortion clinic with a history of safety and medical violations will surrender its license. New Woman All Women Health Care clinic in Birmingham cease operations no later than May 18, following a scathing, 76 page report from the Alabama Department of Public Health.

According to a press release issued on Good Friday, the department found “significant failures in maintaining compliance with the Rules of the Alabama State Board of Health for the safe and effective provision of care.”

Federal agents raided a clinic where abortions are performed and found "deplorable and unsanitary" conditions, including blood on the floor and parts of aborted fetuses in jars, according to the state agency that shut it down and suspended the license of the doctor in charge.
