"My friends on the right don’t like to hear this, but the Constitution is not a clear document.
Written 100 years ago, when America had thirteen states and very different problems, it rarely speaks directly to the questions we ask it." -Ezra Klein, Washington Post, Dec 2010
Retired general and former Democratic presidential candidate Wesley Clark on Friday called for World War II-style internment camps to be revived for “disloyal Americans.”...
He called for a revival of internment camps to help combat Muslim extremism, saying, “If these people are radicalized and they don’t support the United States and they are disloyal to the United States as a matter of principle, fine. It’s their right and it’s our right and obligation to segregate them from the normal community for the duration of the conflict.”
The Democrats demand that Americans be stripped of their Second Amendment rights with no attention paid to the Fifth Amendment, to due process.
They propose that Americans be stripped of their legal protections under the Bill of Rights even when they have not been charged with, much less convicted of, a crime.
They propose that this be done on the basis of a series of secret government lists, whose contents, criteria, and keepers are treated as state secrets. -Kevin D. Williamson

Sen. Tammy Baldwin (D-Wis.) says the 1st Amendment’s religious liberty protections don’t apply to individuals.
On MSNBC last week, Wisconsin’s junior Senator claimed that the Constitution’s protection of the free exercise of religion extends only to religious institutions, and that individuals do not have a right to the free exercise of their own religion.

Rep. Sheila Jackson Lee (D., Texas) declared the U.S. Constitution to be 400 years old Wednesday on the House floor, which would mean it was signed in 1614... Lee is off by only 173 years. It was adopted on Sep. 17, 1787.

A Senate proposal touted as protecting Americans' e-mail privacy has been quietly rewritten, giving government agencies more surveillance power than they possess under current law.
CNET has learned that Patrick Leahy, the influential Democratic chairman of the Senate Judiciary committee, has dramatically reshaped his legislation in response to law enforcement concerns. A vote on his bill, which now authorizes warrantless access to Americans' e-mail, is scheduled for next week.

Rep. Rubén Hinojosa (D-Texas) on Wednesday forgot what the Second Amendment was when asked about it during a debate in McAllen, Texas.
"I'm drawing a blank on the Second Amendment, but I think it's the weapons, isn't it? The NRA?" he said, according to The Monitor. After recalling what the Second Amendment is — the right to keep and bear arms — he then went on to say he supports efforts to put limits on it, by blocking access to certain guns.
It is a measure of the corruption of the Democratic party and its ability to inspire corruption in others that John Lewis, once a civil-rights leader, is today leading a movement to strip Americans of their civil rights based on secret lists of subversives compiled by police agencies and the military. -Kevin D. Bidondi's exact words to Miller were: "The Second Amendment shall not be infringed, you people need to understand that." Miller's exact response was: "Go fu*k yourself." Miller's camera man/photographer then leaned in to the microphone and said, "Yeah, go fu*k yourself."

Constitutional Authority for the ACA
Most of us know that when then-Speaker Pelosi was asked where the Constitution gives Congress the power to enact an “individual mandate,” she replied with a mocking “are you serious? Are you serious?”
Here are a few more pearls of constitutional wisdom from our elected representatives. -David Bernstein
• Rep. Conyers cited the “Good and Welfare Clause” as the source of Congress’s authority [there is no such clause].
• Rep. Stark responded, “the federal government can do most anything in this country.”
• Rep. Clyburn replied, “There’s nothing in the Constitution that says the federal government has anything to do with most of the stuff we do. How about [you] show me where in the Constitution it prohibits the federal government from doing this?”
• Rep. Hare said “I don’t worry about the Constitution on this, to be honest […] It doesn’t matter to me.” When asked, “Where in the Constitution does it give you the authority …?” He replied, “I don’t know.”
• Sen. Akaka said he “not aware” of which Constitutional provision authorizes the healthcare bill.
• Sen. Leahy added, “We have plenty of authority. Are you saying there’s no authority?”
• Sen. Landrieu told a questioner, “I’ll leave that up to the constitutional lawyers on our staff.”

Jan Crawford of CBS reports that a three-member panel of the 5th Circuit Court of Appeals has ordered the U.S. Department of Justice to "answer by Thursday whether the Obama Administration believes that the courts have the right to strike down a federal law."
The response is to be three pages long, single-spaced, according to an unnamed lawyer who was in the courtroom. The court's response appears to be a direct challenge to President Barack Obama's attack yesterday on the Supreme Court and the power of judicial review, which federal courts have exercised for over 200 years.

Let me remind you this [Americans allegedly dying because of lack of universal health care] has been going on for years. We are bringing it to a halt.
The harsh fact of the matter is when you're going to pass legislation that will cover 300 [million] American people in different ways it takes a long time to do the necessary administrative steps that have to be taken to put the legislation together to control the people.

Chairman Tom Perez
October 2017
"The Electoral College is not a creation of the Constitution. It doesn't have to be there."
Contrary to Perez's claim, the U.S. Constitution establishes the Electoral College in Article II, and the 12th Amendment details the process by which electors will meet and vote for president and vice president:
"Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors, equal to the whole Number of Senators and Representatives to which the State may be entitled in the Congress: but no Senator or Representative, or Person holding an Office of Trust or Profit under the United States, shall be appointed an Elector," Article II states. -Melissa Quinn

When CNSNews.com asked House Speaker Nancy Pelosi (D-Calif.) on Thursday where the Constitution authorized Congress to order Americans to buy health insurance--a mandate included in both the House and Senate versions of the health care bill--Pelosi dismissed the question by saying: “Are you serious? "In the months and years to come, Democrats will have to adopt a forceful procedural radicalism that treats the Constitution as an obstacle to a political system that is genuinely accountable to the public."
